An example of how things should not work.

New York Times: Voting Irregularities in Kenya Election Are Confirmed, Adding Fuel to Dispute.

“But Mr. Odinga’s lawyers staunchly disagree. They have claimed there was a conspiracy to rig the election, and they have argued that because Mr. Kenyatta skirted a runoff by such a tiny margin, some 8,000 votes out of more than 12 million, the errors that have been discovered are enough to mandate a new election. . . . But if the court rules against Mr. Kenyatta and orders a runoff or a new election, what will his passionate supporters do? Mr. Kenyatta has been charged by the International Criminal Court with crimes against humanity, accused of using his vast family fortune to bankroll death squads during the election chaos of 2007 and early 2008.”

And President Obama congratulates Uhuru on election victory:

“President-elect Uhuru Kenyatta and his Deputy William Ruto today received a congratulatory message from America’s President Barrack Obama on their election in last month’s general elections.  . . . President Obama said the electoral process and the peaceful adjudication of disputes that ensued are testaments to the progress Kenya has made in strengthening its democratic institutions.  Mr Obama said, ‘Now that your election has been confirmed, you have the opportunity to build on the promise of Kenya’s Constitution and solidify its place as a vibrant and prosperous democracy centered on the rule of law.’”

    The Supreme Court of Kenya unanimously ruled 6-0 that the elections were free and fair. The people of Kenya spoke and elected their leaders in a democratic manner. In 1997, 2007 and now 2013, the petitioner has consistently not accepted the outcome of elections. The Guardian Newspaper in the UK notes it best “The supreme court’s verdict, when it came, was not unexpected. Defeated presidential candidate Raila Odinga, the perennial runner-up, had insisted from the moment it became clear that he was on the losing side yet again that the election was flawed, citing counting errors, technological faults and mysterious unmarked registers. But if there was a case to be made, his legal team bungled it with late submissions and dodgy affidavits which saw some of the most compelling evidence thrown out of court.” http://bit.ly/Z6671P The ICC cases continue to collapse with multiple witnesses coming forward to state that they were coached and paid to offer false testimony while the ICC now claims the same witnesses are intimidated in a face saving move. So how should things work? To the whims of non-Kenyans who want to impose puppets or to the democratic wishes of Kenyans? It is Kenyans who live in Kenya not foreigners residing in far away lands who lack respect for the electorate and legitimate local institutions such as the judiciary. The election was also a referendum on the ICC cases, the vast majority of the Kenyan people do not viewed them as valid but as trumped up and fabricated against individuals whom if you must be reminded remain innocent until proven otherwise. It is now clear that the United States was right to have withdrawn from the ICC.
