The Virginia Attorney General was just on WMAL. He said that the Virginia Attorney General does not have authority to investigate the voter fraud.  Virginia Attorney General Ken Cuccinelli says that only the State Board of Elections can vote to ask for an investigation.   Cuccinell also said “there is no indication that prior to being ambushed by the camera he had any intention of doing this.  At one point he said why don’t you just try to get these people to vote.  . . .  What we really want people to do in his position is to say ‘are you out of your mind?'”  This is a lack of scienter defense, the sort of defense criminal defense attorneys would present in court.

The WMAL host (including Larry O’Conner from Breitbart) pressed the AG.  “Isn’t there anything about this that is patently illegal?”

“It is so important for both sides to be part of the process of the vigilant defense of the right to vote and Pat Moran failed that test.”

“Do you expect the SBE to ask you to do it?”

Cuccinelli says, “no I don’t.  Here they were talking about how one might commit and offense but there is no indication that any offense took place.”
