The conduct of Eric H. Holder, Jr. as the 82nd Attorney General of the United States is repugnant and reprehensible. Today, U.S. Attorney Patrick Fitzgerald a U.S Attorney for Northern District of Illinois has announced that he will resign from the position. Mr. Fitzgerald was nominated for the appointment of U.S. Attorney for the Northern District of Illinois in 2001 by President George W. Bush with the recommendation of then-junior United States Senator Peter Fitzgerald (R) who is not related to U.S. Attorney Patrick Fitzgerald. U.S. Attorney Patrick Fitzgerald has said that public service is his life’s work. He prosecuted two Illinois Governors: George H. Ryan (R) and Rod R. Blagojevich (D). Scooter Libby who was a member of the Bush 43 Administration whose positions were Assistant to the Vice President for National Security Affairs and Chief of Staff to the Vice President of the United States and Assistant to the President. Mr. Libby was prosecuted by Patrick Fitzgerald and was convicted on two counts of perjury, two counts of making false statements to federal investigators, and one count of obstruction of justice. A person like Peter Fitzgerald would be an appropriate nominee to be the 83rd U.S. Attorney General to succeed the Dishonorable Eric H. Holder, Jr. in a Romney Administration. The Section 5 provision of the Voting Rights Act does exceed the enumerated legislative powers granted to the Congress, is inconsistent with Article IV and the Tenth Amendment to the Constitution. Justice Clarence Thomas would sympathize with the states on the constitutional question of Section 5. TX Attorney General Gregg Abbott has retracted his objection to deposing the legislators who authored S.B. 14 the new strict voter-ID law. The Texas versus Holder or the Shelby County, AL versus Holder case could equal the ultimate nullification of the Section 5 provision of the Voting Rights Act. The preclearence regime does intrude into state sovereignty.
